Legal Force of Judgements Passed by the NCoA

The legal force of a judgement passed by the National Court of Arbitration is equal to the legal force of a judgement passed by a state court. In order to institute enforcement proceedings on the basis a judgement passed by or a settlement concluded before the NCoA, a state court must issue a writ of execution regarding that judgement or settlement.

Judgements passed by the NCoA and settlements concluded before the NCoA are enforceable also outside Poland, pursuant to the Convention on the Recognition and Enforcement of Foreign Arbitral Awards adopted in New York on June 10, 1958. Poland submitted its instrument of ratification to the United Nations Secretariat on October 3, 1961. Currently, 159 countries are signatories to this Convention.
